My stationary car was hit by an uninsured driver in March 09. The insurance company made me pay 500 excess and said that this will be fully recoverable as the other driver was at fault. The car was then written off and I was paid the value of the car. In December the other driver was found guilty of driving without insurance, fined and given penalty points. Even though my policy gives me legal cover, it has now been 11 months since the incident and they do not seem to be very active. Also, my policy expires next month and as the claim is still open, the insurers assume that I lost my no claim bonus and quoted me twice as much for the renewal. My mum and dad's combined cost of car insurance on their Range rover sport HSE TDV6 (2.7litre) is around 1200. My dad rang up his insurance broker to get a quote on putting me as a named driver, and we got a quote of a total of about 6,000 per year. I know this is a lot of money, however the insurance company says this is because the car is in bracket 19. I was led to believe by my Land Rover dealer that the TDV6 model was in group 14/15, where it was the Supercharged 4.4litre model which was in group 18/19. Given i am 20 years old, having held my lisence for around 3 years with no motoring convictions against my name, and having also been a named driver for the best part of 3 years on a Ford Focus. After they buy the car from me, they will sell it to salvage, expect to get 2k from it, and only be out 5400 instead of a full cost of repairs. So I've had the car for a year and half, taken out on a 5yr car loan. I still owe 12k on it. After they cut a check to the lean holder, I'm still responsible for 5k on that loan. The bank and my insurance at the time didn't offer gap insurance. Stupid of me, I let my current policy expire to search around for a more affordable policy. I kept procrastinating, and the accident happened with me having no insurance. Lucky he hit me and is at fault. I'm trying to see what my options are. I've gone to the liable company's website and see their basic plan for my state, law requires 25k in property liability for at fault accidents, plus medical etc. So I'm wondering what should I expect from the lady handling this claim. I'm not fooled when she called me yesterday and said that she is here to work with and for me. Saying that there is probably a lot of talk about lawyers, just know they will take 30-40% of you settlement. Know that I'm here to work for you, try to work with me I'm thinking my head total bull crap. 1, she works for her insurance company first, and will have their interest first, 2, she works for their client and to protect them from me in a suit. In the end, I'm not stuck with a car that they will not fully pay to have repaired, and will still owe 5k after they pay the loan holder the value of the car. My credit is damaged and getting a new loan is probably not going to happen easily. I really don't want to get a lawyer but I now have a car sitting in my driveway that I can't use plus a balance in the end. Anyone got some suggestions as to what I should realistically expect. The lady mentioned a liability settlement, repair settlement, medical expenses settlement, and personal injury settlement. I'm not out to make money on this as that just will not happen. But I have no car and will owe 5k still. I'm just like...f**k

Why is it that I am still able to be sued for an auto accident if I live in Florida, a no-fault state?

I've been in 2 accidents. The first was very minor; I rolled into the bumper in the car in front of me at a stop light and scratched their bumper. No damage was sustained to my car, but I am at-fault. The second I was cutting through an intersection that was at a red light and was about to pull into the left-turn lane when the woman in the car that was coming down the lane wasn't looking forward and hit the driver side door of my car. I was already halfway in the lane trying to straighten out into the left-turn lane but I couldn't move when she was coming, because if I moved back I might have hit someone and if I went forward she would have hit me anyway. At the scene the policewoman told me I was at fault, but when I talked to my claims adjuster, she told me that there is some negligence on the other party's part because if I had just randomly pulled out into traffic, the other party would have hit the front of my car, not the driver-side door. I am being sued by the first person and I found out just now I am being sued by the person in the second accident as well. I was told that since I am registered under my parents insurance, the other party can see that they have a lot of assets they can sue for from my parents. My question is, why are they able to sue me so easily? I've done research, and I know Florida is a no-fault state, meaning drivers cannot sue each other unless serious injury occurred, such as loss of life, limb, permanent injury, etc. In both accidents, I did not get ticketed, and I believe no police report was written, only exchanges of information.(Police were called, however. I did not leave the scene) Also both of the other parties did not ask for an ambulance or medical assistance(I know about the feeling pain later thing) but I'm sure if someone was suing for something as serious that can be listed as loss of limb or death, they would have showed some indication of injury at the scene. Both people stepped out of their cars and were fine, however.

I have a car that is worth no more than $1500. I bought it off someone in my family and I should transfer ownership (as it is from a different state). At the moment they have selected me as a secondary drive for insurance, as I am a P plater it will cost a lot of money to put it under me. To reregister it and insure it under me would cost a lot. (including getting another roadworthy certificate). I took it in for a check and they said repairs would cost nearly $2,000 which is more than the car. Plus the insurance, totaling about $3500 in total when the car is only worth $1500 max. So this is the situation I need help with, the car runs great and I may have just gotten ripped off by the mechanics (I didn't bring it in, someone else did and they can seem like an easy person to rip off) - also we have a friend who is a retired mechanic and he said the car is in great shape and roadworthy should be no problem, so that conflicts with what these guys said.. My 17 year old daughter is currently on my automobile insurance policy. She drives my car at times. She'll be 18 next February. Sometime this year, I wanted to get a new car and give her this one. If we have the car registered in her name when I give it to her, does she then need her own seperate insurance policy? Can she still be under my insurance although the car would no longer be registered in my name? I think seperate insurance for her (at her age) would be considerably more expensive.
